Prayer:Writ Petitions filed under Article 226 of the Constitution of India, to issue a Writ of mandamus to direct the respondents 1 and 2 to pay compensation to a tune of Rs. 20, 00, 000/- (Rupees Twenty Lakhs only) for the death of Arun Kumar aged about 19 years who died due to electrocution. Ms.Keerthana Shenoi, learned counsel for Mr.L.Jai Venkatesh, learned counsel accepts notice for R1 and R2 and Mr.TNC Kaushik, learned Additional Government Pleader accepts notice for R3.
2. The petitioners' son one Mr.Arun Kumar on 03.10.2020 sustained fatal injuries on account of electrocution by an electric wire passing to the mini water tank motor. The petitioner alleges that the live wire had electric current leading to this fatality.
3. On this account, an FIR has been registered in Crime No.2331 of 2020 and based on complaint given by the uncle of the deceased, an enquiry is stated to be ongoing. That apart, the petitioner had made a representation before the Authorities as well and proceedings dated 17.06.2021 had been issued as an interim proceeding setting out preliminary findings of R1 and R2.
4.Ms.Keerthana Shenoi, learned counsel, who has accepted notice on behalf of the Electricity Department i.e. R1 and R2 would submit that enquiry upon the representation of the petitioner is ongoing and no final decision has been taken thereupon.
5.She assures the Court that the petitioner will be heard, the result and deliberations in the ongoing enquiry before the Police will also be taken note of, all relevant persons will be enquired with and final orders passed on the representation of the petitioner seeking compensation for the untimely demise of her son, within a period of eight weeks from today. Mr.TNC Kaushik, learned Additional Government Pleader also assures the Court that the enquiry will be concluded expeditiously after hearing the parties.
6.Recording the aforesaid and as the mandamus sought for stands achieved by virtue of the aforesaid directions, this writ petition is closed. No costs.
