This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.Venkatesaperumal learned counsel for appellant and Mr.M.Sirajudheen, learned counsel for the first respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter and filed a memorandum of settlement, which reads as follows:
TERMS & CONDITIONS OF SETTLEMENT This Writ Appeal is at the instance of the employer, challenging the award of the writ Court in W.P.No.42709 of 2016 dated 31.01.2023.
2. Today, the parties as well as their respective counsel are present.
3. The appellant has aggrieved to reinstate the respondent without back wages. In fact, the minutes of Board Meeting dated 26.09.2024 is also presented before us and the same is extracted hereunder:- "Resolved to ratify the action taken by the Managing Director in having preferred Writ Appeal against the orders of Hon'ble High Court in W.P.No.42709 of 2016 dated 31.01.2023 and to settle in Lok Adalat that the Ex-Conductor forego back wages from the date of removal (10.03.2014) to date of reinstatement (12.10.2020) and to treat as non eligible days and also other benefits except 12(3) settlement benefits and to settle arrear of salary for working period after deducting paid salary in respect of Thiru.M.Chandran, Ex-Conductor Staff No.CR.4229 of Villupuram Region as recommended by the Finance Committee."
4. The first respondent/ writ petitioner is also agreeable to settle the writ petition in the above terms.
5. In view of the above, the writ appeal is disposed of. The General Manager, Tamil Nadu State Transport Corporation (Villupuram) Ltd., Vazhuthareddy, Salamedu, Villupuram Region, Villupuram - 605 602.
