C.M.P.No.1401 of 2010 has been filed to condone the delay of 2481 days in filing the petition to set aside the abatement. 2.C.M.P.No.1402 of 2010 has been filed to set aside the abatement caused due to the death of the 1st appellant i.e. Venkatachala Maistry in the above second appeal. 3.C.M.P.No.1403 of 2010 has been filed to bring on record the proposed petitioners 14 to 24/ proposed parties, the legal representatives of the deceased 1st Appellant in the second appeal, as 14th to 24th appellants.

5.Being satisfied with the reasons stated in the affidavit filed in support of these petitions, these petitions are allowed. 12.12.2019 (3/3) kas Note: Registry is directed to make necessary amendment in the second appeal and list on 08.01.2020 along with S.A.No.658 of 1997.
