ORDER

This Criminal Original Petition is filed to direct the 2nd respondent to register a case on the basis of the Complaint dated 12/02/2015 and to investigate the same under the supervision of the 1st respondent within a time frame.

2. This petition has come up today for admission. I have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and I have also perused the records carefully.

3. On a reading of the complaint, it essentially appears that there is a dispute between the person who purchased a flat and a person who had promoted the apartment. The allegation of the petitioner is that the flat promoter has promised that he will provide all facilities like CBSE school, Multi Specialty Hospital, Club Houses etc. After making the promise, the apartment has not been provided with those facilities. On the allegation of this nature, the police cannot enquire and at the most the petitioner can complain about deficiency of service and seek for compensation. Under such circumstances, no positive direction can be given on the complaint of the petitioner dated 12.02.2015. https://hcservices.ecourts.gov.in/hcservices/

4. Hence, the Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
