Mr.A.Gopinath Government Advocate (Crl.Side) Order (Order of the Court was made by K.Rajasekar J.) The petitioner herein, who is an accused in S.C. No.537 of 2024 pending on the file of the learned Additional District and Sessions Court - IV, Ponneri, had jumped bail on 30.06.2024. He was secured on execution of Non-Bailable __________Page 1 of 5
Warrant after an order dated 02.07.2025. He seeks for bail stating that he is in prison for more than 30 days.

The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail to the petitioner and submitted that the petitioner had earlier jumped bail and remained absconding for a long period. He further submitted that if released on bail, the petitioner may once again abscond. The trial has been delayed due to the petitioner's absence, thereby affecting the rights of co-accused, who have been regularly appearing before the Court.
3. Earlier, this Court dismissed the bail petition filed by the petitioner on two occasions on the ground that considering the conduct of the petitioner and the seriousness of the violation of bail conditions. Now it is reported that the case is still at the trial stage and the co-accused was absconding one by one and though it is stated that the trial is not progresses and considering the period of his incarceration, this Court is inclined to grant bail to the petitioner with certain conditions.
4. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Additional District and Sessions Court-IV, Ponneri Thiruvallur District, and on further conditions that:
[a] the sureties shall affix their photographs and Left Thumb __________Page 2 of 5
Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; [b] the petitioner shall report before the concerned Court daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation.
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 6300];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
