2024-03-18Honourable Mr Justice R. Mahadevan,Honourable Mr Justice Mohammed Shaffiq3 pages

CMP.Nos.1546, 1550 and 1554 of 2024 in WA.Nos.1906, 2608 and 1897 of 2022 R. MAHADEVAN, J.

AND MOHAMMED SHAFFIQ, J.

(Order of the Court was made by R.MAHADEVAN, J.) These petitions have been filed by the proposed parties to implead themselves as respondents in WA.Nos.1906, 2608 and 1897 of 2022.

2. The learned counsel for the petitioners submitted that the petitioners/ proposed parties are the Post Graduate Doctors working as Assistant Professors in the various Medical Colleges and they are identically situated persons as that of the private respondents in these writ appeals. Adding further, the learned counsel submitted that similar to respondents 1 and 2, the petitioners are also the service candidates and they have similar grievances against non-service candidates regarding regularisation and promotion. However, the petitioners are seniors to the respondents 1 and 2 and were qualified and included in the promotional panel as per circular dated 29.12.2022 and they also participated in the promotion counselling. Even thereafter, they were not given promotion by the sixth respondent without any valid reason. The learned counsel also submitted that in these appeals, viz., W.A.Nos.2608, 1906 and 1897 of 2022, this Court has passed an order dated 17.11.2023 directing the sixth respondent 1/3

to keep 12 posts vacant and fill up the balance vacancies for the post of Associate Professors and that, all other promotions are subject to the outcome of the orders to be passed in the writ appeals. Pursuant to the same, the sixth respondent has not filled up the said 12 posts of Associate Professor and the same caused serious prejudice to the petitioners herein. Hence, the petitioners have sought to implead themselves as parties to the appeals by filing these miscellaneous petitions.

3. The learned respective counsel for the respondents have no serious objection for ordering these petitions.

4. Considering the reasons stated in the affidavits filed in support of these petitions and also having regard to the no objection expressed on the side of the respondents, these petitions are ordered as prayed for.

5. Registry is directed to carry out the necessary amendment in the writ appeals.
