ORDER

Petition seeking bail in connection with Spl.S.C.No.153 of 2022 pending on the file of the learned Session Judge, Mahalir Neethimandram, (FTMC) Tiruppur, in connection with Cr.No.170 of 2022, registered for the offences punishable under Sections 5(I) r/w Section 6 of Protection of Child from Sexual Offences Act, 2012 and Section 366 of IPC, is on board for 1/4

consideration.

2. Learned counsel appearing for the petitioner submitted that the petitioner is facing trial in Spl.S.C.No.153 of 2022 on the file of the learned Session Judge, Mahalir Neethimandram, (FTMC) Tiruppur, for the offences under Sections 5(I) r/w Section 6 of Protection of Child from Sexual Offences Act, 2012 and Section 366 of IPC. He further submitted that the petitioner has been regularly appearing before the trial Court on all hearing dates, while so, as he was unable to appear before the trial Court on 13.09.2023, thereby, a Non Bailable Warrant was issued by the trial Court, against him. He also submitted that the petitioner is ready to appear before the trial Court and and also he is ready to co-operate for speedy disposal of the trial. Hence, he prays for grant of bail to the petitioner.

3. Learned Government Advocate (Crl.side) submitted that it is a case of jumped bail. He also submitted that due to the absence of the petitioner on 13.09.2023, the trial Judge is unable to proceed with the trial and now the case stands posted on 04.02.2025 for examination of Investigating Officer. At this stage, if the petitioner is enlarged on bail, there is every possibility of 2/4

the petitioner absconding and not appearing for trial, and he objected for grant of bail to the petitioner.

4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) for the respondents and perused the materials available on record.

5. Taking into consideration the facts and circumstances of the case and that it is a case has been posted for examination of I.O, this Court is not inclined to grant bail.

6. Accordingly, the Criminal Original Petition stands dismissed. 23.01.2025 Anu To The Inspector Of Police Thali Police Station, Udumalpet, Tiruppur District.
