C.M.P.No.1407 of 2010 has been filed to condone the delay of 342 days in filing the petition to set aside the abatement. 2.C.M.P.No.1408 of 2010 has been filed to set aside the abatement caused due to the death of the 3rd respondent i.e. Periyasamy Udayar in the above second appeal. 3.C.M.P.No.1409 of 2010 has been filed to bring on record the 4th and 5th respondents / proposed parties, the legal representatives of the deceased 3rd respondent in the second appeal, as 4th & 5th respondents.

5.Being satisfied with the reasons stated in the affidavit filed in support of these petitions, these petitions are allowed. 12.12.2019 (1/3) kas Note: Registry is directed to make necessary amendment in the second appeal and list on 08.01.2020 along with S.A.No.658 of 1997.
