This petition has been filed for transfer of investigation in Crime No.192 of 2023 pending on the file of the second respondent to any other investigating agency.

2. Heard Mr.B.Leelesh Sundaram, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondents 1 and 2.

3. When the matter was taken up for hearing, learned Additional Public Prosecutor submitted that there is a case in counter and the second respondent is investigating Crime Nos.191 and 192 of 2023 for the same incident that had taken place on 09.06.2023. Learned Additional Public Prosecutor submitted that effective investigation will be conducted by the second respondent and final report will be filed as expeditiously as possible before the concerned jurisdictional Court.

4. Considering the fact that a case in counter is being investigated by the second respondent and First Information Report itself has been registered only on 10.06.2023 and that the second respondent has also 2/4

given an undertaking that the investigation will be proceeded further effectively in accordance with law, this Court deems it fit not to transfer the investigation at this stage. Some reasonable time can be granted to the second respondent to proceed with the investigation in Crime Nos.191 and 192 of 2023.

5. The investigation shall be completed and final report shall be filed before the concerned jurisdictional Court within a period of three (3) months from the date of receipt of a copy of this order. If, in case, the investigation does not proceed further effectively, at a later point of time, it will be left open to the petitioner to approach this Court.
