O R D E R

This Civil Revision Petition has been filed seeking a direction to the Additional Family Court, Coimbatore to dispose the I.A.No.1 of 2019 in H.M.O.P.No.754 of 2018.

2. In view of the order being passed in the Civil Revision Petition, notice to the respondent is dispensed with.

3. According to the petitioner, the respondent/wife has filed a petition in H.M.O.P.754 of 2018 under Section 9 of the Hindu Marriage Act for Restitution of Conjugal Rights. In the above petition, the petitioner/husband has filed an interlocutory application to reject the O.P. on the ground that marriage has not been taken place between the petitioner and the respondent. Even though the application has been filed in the year 2019, the application was not taken up for hearing. Hence, the present revision has been filed.

4. Considering the limited prayer sought in the revision, without going into the merits of the case and also the fact that the interlocutory application is pending from the year 2019, the learned Additional Family Court Judge, Coimbatore, is directed to dispose the I.A.No.1 of 2019 in H.M.O.P.No.754 of 2018 within a period of four(4) weeks from the date of receipt of a copy of this order, after giving opportunity to both the parties, on merits and in accordance with law.

5. With the above directions, this Civil Revision Petition is disposed of. No costs.
