ORDER

This writ petition has been filed for a direction, directing the 2nd respondent to consider the representation submitted by the petitioner dated 19.12.2025 seeking to defreeze of his company's account. 2.The petitioner is an accused in Crime No.32 of 2026 registered for the offences punishable under Section 318(4), 316(2) of BNSS, 2023., alleging that the petitioner received money to the tune of Rs.8,92,000/- from the 3rd respondent, who is newly impleaded in this Writ Petition vide WPMP Crl.No.161 of 2026, in order to redeem the jewels, which was pledged by him. Thereafter, the petitioner cheated the said amount without repaying the same. 3.On account of registration of F.I.R. the 1st respondent instructed the 2nd respondent to freeze the account of the petitioner maintained in the 2nd respondent's bank bearing account No.10185933768. Thereafter, the 3rd respondent filed a petition in Crl.M.P.No.143 of 2026 for return of the said

property which was seized by the 1st respondent herein in Crl.M.P.No.143 of 2026. The trial Court allowed the petition on condition that the 3rd respondent shall execute a bond for a sum of Rs.6,72,696/- with one surety. It was also executed by the 3rd respondent. However, the said order has not been complied with so far, since the pendency of this Writ Petition. 4.Further, the petitioner also did not challenge the order of return of property so far. Whatever amount is lying with the petitioner's account now ordered to be returned in favour of the 3rd respondent herein. Investigation in this case is still pending in Crime No.32 of 2026. Therefore, the representation submitted by the petitioner seeking to defreeze his company's account cannot be considered. This Court finds that the Writ Petition is devoid of merit and is liable to be dismissed.

5.This Writ Petition stands dismissed accordingly. The 3rd respondent can very well execute the surety as directed by the trial Court and the 2nd respondent is directed to comply with the order passed by the trial Court. No costs. WPMP Crl.No.161 of 2026 stands ordered.
