ORDER

The order challenged in this Revision is an exparte order for delivery made by the Executing Court on 13.12.2019 in EP No.1341 of 2019, which was filed seeking execution of the eviction order in RCOP No.1523 of 2017. It is now conceded by the counsel for the parties that the tenant has already filed an appeal against the order of eviction and the Appellate Authority has granted stay of execution of the eviction order in RCA No.54 of 2020. The Appeal is said to be pending.

2. In view of the same, nothing survives in the revision, the Civil Revision Petition is dismissed as having become infructuous. Consequently, the connected miscellaneous petition is closed. No costs. 23.11.2021 jv Index: No Internet: Yes speaking order 2/4
