Respondents Prayer: Criminal Original petition is filed under Section 482 of Cr.P.C, to direct the respondents 2 and 3 to monitor the investigation conduct by the 4th respondent with further direction to direct the 4th respondent to include the section for the offence punishable under Section 324, 326, 506 (ii) & 307 of IPC in Crime No.308 of 2018 pending on the file of the 4th respondent police and file the final report within a stipulated period of time.

ORDER

This petition has been filed seeking to direct the respondent police to alter the FIR and to add Section 324, 326, 506 (ii) & 307 of IPC in the FIR.

2. The learned Additional Public Prosecutor on instructions would submit that the FIR was registered only on 12.12.2018 for offence under Section 294(b) and 323 of IPC. The investigation is in progress. If in the course of investigation, the respondent police collected sufficient materials, the offences will be accordingly altered and all the accused persons will be brought to book.

3. In view of the above submission, there shall be a direction to the fourth respondent to continue the investigation effectively and based on the materials collected during the course of investigation, either alter the FIR or file the final report by showing the necessary offences. All the persons involved in the crime shall also be made as accused persons.

4. This Criminal Original Petition is disposed of with the above direction.
