Both the criminal original petitions are interlinked and the parties are one and same, and hence the same are disposed of by this common order.
The respondent herein filed two private complaints under Section 200 of Cr.P.C for the offence under Section 138 of Negotiable Instruments Act, against the petitioners, which were taken on file in C.C.No.1191 & 1113 of 2013. Pending the above cases, the petitioners herein filed these petitions seeking to quash the same.
When the matter is taken up for hearing there is no representation on behalf of the petitioners. Heard the learned counsel appearing for the respondent and perused the materials available on record.
It is submitted by the learned counsel appearing for the respondent that trial already commenced in the above two calender cases. Further complainant side evidence has been completed and the case was posted for examination of defence side witnesses. Therefore, at this stage, the above calender cases cannot be quashed.
In view of the above, these criminal original petitions are dismissed. Consequently connected miscellaneous petitions are closed. However, since the calender cases are pending from the year 2013, the learned Magistrate, is directed to dispose of the same in accordance with law within a period of one month from the date of receipt of a copy of this order.
