..Respondent Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to call for the records pertaining to the impugned Refusal Check Slip No.RFL/ Thingalur/ 91/ 2025 dated 23.12.2025 of the respondent and quash the same and consequently direct the respondent to register the Sale Deed dated 23.12.2025, which was presented by the petitioner.

ORDER

The petitioner traces title to 64 cents in S.Nos.490/3 & 490/4 at Siruvalur village from his great grandfather, namely, Rame Gounder. Intending to sell the property, the petitioner executed sale deed dated 23.12.2025 in favour of one K.Vasu and presented the same for registration. The request was declined under the impugned refusal check slip on the ground that the petitioner had failed to produce the death and legal heir certificates of Rame Gounder.

2. Learned counsel for the petitioner submits that the death and legal heir certificates of the petitioner's father and grandfather were produced. He also submits that the petitioner is not in a position to produce the death and legal heir certificates of his great grandfather at this distant point of time. He relies upon an earlier order of this Court in Sajitha Parveen v. The Sub-Registrar, Ilayankudi, Sivagangai District, WP(MD)No.21522 of 2021, dated 22.12.2023.

3. Mr.Jayachandran, learned Government Advocate, accepts notice for the sole respondent. He submits that the petitioner's request would be reconsidered subject to submission of an affidavit explaining the reasons for not

being in a position to submit the death and legal heir certificates of the petitioner's great grandfather.

4. The petitioner's great grandfather died in the year 1972. At this distant point of time, the petitioner cannot be expected to submit the death and legal heir certificates. It should be noticed that the petitioner has submitted the death and legal heir certificates of his father and grandfather. Therefore, the impugned refusal check slip cannot be sustained and is set aside. As a corollary, the petitioner shall re-present the sale deed before the registering officer within two weeks from the date of receipt of a copy of this order. Subject to submission of an affidavit explaining the reasons for inability to produce the death and legal heir certificates of Rame Gounder and the fulfillment of other requirements relating to registration, the registering officer shall register the sale deed within two weeks from the date of re-presentation.

5. The writ petition stands disposed of on the above terms without any order as to costs. Consequently, connected miscellaneous petition is closed. 03-02-2026 Index : Yes/No Internet:Yes/No kj
