ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.10.2020 for the offences punishable under Section 366 of IPC and Section 5(I) r/w. Section 6 of Protection of Children from Sexual Offences Act, 2012, in Crime No.9 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner on the guise of marriage had sexual intercourse with the 17 years old victim girl and subsequently refused to marry her.

3. There is no representation for the learned counsel for the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner is working as a Professor and the allegation is that he promised to marry the victim girl and had sexual intercourse and subsequently failed to marry her. She would further submit that the victim girl is a minor aged about 17 years and there is specific overt act. The respondent police had also recorded statement under Section 164 Cr.P.C from the victim girl. Hence, she vehemently opposed for grant of bail to the petitioner.

5. Taking into consideration, the serious nature of the offence alleged to have committed by the petitioner, this court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
