Mr.C.Jayaprakash Govt Advocate for R1 to R3 Order This writ petition has been filed seeking for a direction to respondents 2 to 5 to delete/remove the name of the petitioner from the revenue records for the property, morefully described in the prayer to this writ petition and consequently, direct respondents 2 to 5 to effect mutation and issue patta for the property in favour of the rightful owners i.e. (i)Thayalnayaki, (ii))Malar @ Malarkodi, (iii) Sundari and (iv)Sasikala, the four daughters of late Rajakumari, based on the Will dated 16.05.2008.
2.The petitioner claims that erroneously, his name has been included in the revenue records maintained by the respondents for the property, morefully described in the prayer to this writ petition. The petitioner seeks for deletion/removal of his name from the revenue records for the property, morefully described in the prayer to this writ petition and he also consequently, seeks for a direction to respondents 2 to 5 to effect mutation and issue patta for the property in favour of the rightful owners, based on the Will dated 16.05.2008. The petitioner had given a representation for the aforesaid purpose on 01.12.2025. Since the said representation has not been considered till date, the petitioner has filed writ petition.
3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 1 to 3.
4.No prejudice would be caused to the respondents if the petitioner's representation as stated supra, is considered, on merits and in accordance with law, within a time frame to be fixed by this Court, after hearing the necessary parties.
5.This Court is not expressing any opinion on the merits of the petitioner's representation.
6.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 01.10.2025 seeking for deletion/removal of his name from the revenue records for the property, morefully described in the prayer to this writ petition and consequently, direct respondents 2 to 5 to effect mutation and issue patta for the property in favour of the rightful owners, (i)Thayalnayaki, (ii))Malar @ Malarkodi, (iii) Sundari and (iv)Sasikala, the four daughters of late Rajakumari, based on the Will dated 16.05.2008, within a period of 12 weeks from the date of receipt of a copy of this order.
