The present application is filed by the 2nd defendant to condone the delay of 80 days in filing the written statement along with 6 documents.

2. This application is pending from the year 2022. Though the reasons stated in the accompanying affidavit are not satisfied and though this application is filed after a period of 30 days from the date of service of summons, however, this application is filed within a period of 120 days from the date of service of summons. Therefore, in order to give an opportunity to the applicant/2nd defendant, the delay is condoned subject to payment of cost of Rs.10,000/-.

3. The applicant is directed to pay the said cost of Rs.10,000/- (Rupees Ten Thousand Only) to the credit of Advocate Clerks Welfare Association on or before 31.07.2024.
