ORDER

This writ petition has been filed, seeking to forbear the respondents 1 to 4

from surveying and demarcating the property morefully described in the prayer to this writ petition and from issuing any separate patta in favour of the fifth respondent, pending disposal of the Civil Suit in O.S.No.69 of 2023 on the file of the Sub Court, Harur.

2. The petitioner submits that due to pendency of civil suit in O.S.No.69 of 2023 between the petitioner and the fifth respondent, the official respondents are not empowered to survey and demarcate the boundaries as requested by the fifth respondent. The grievance of the petitioner before this Court is that despite raising several objections by the petitioner before the official respondents, the official respondents are ignoring the same and are attempting to survey and demarcate the boundaries of the property on a request made by the fifth respondent despite the pendency of the civil suit.

3. Necessarily, the official respondents will have to consider the petitioner's objections and only thereafter, take a decision with regard to the request made by the fifth respondent for survey and demarcation of boundaries for the property morefully described in the prayer to this writ petition.

4. Accordingly, this writ petition is disposed of by directing the official respondents which includes the third and fourth respondents to consider the petitioner's objections, opposing the survey and demarcation of the boundaries

of the property morefully described in the prayer to this writ petition based on the request made by the fifth respondent and only after considering the said objections on merits and in accordance with law, the third and fourth respondents shall conduct survey and demarcation of the boundaries as requested by the fifth respondent. The fifth respondent is also permitted to counter the objections raised by the petitioner before the official respondent. No Costs.
