: Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Declaration to declare the provisions of the Tamil Nadu Tax on Entry of Motor Vehicles into Local Areas Act, 1990, as unconstitutional ultra vires Articles 14, 19(1)(g), 301 and 304(a) and (b) of the Constitution of India and being unenforceable and of no effect insofar as the petitioner is concerned.

The petitioner is challenging the provisions of the Tamil Nadu Tax on Entry of Motor Vehicles into Local Areas Act, 1990. In the present case, the vehicle involved is Tipper for use of the quarry.

According to the respondents, the said Tipper can ply on the road.

None appears for the petitioner. If on the next date, none appears for the petitioner, the matter would be dismissed.

Place the matter on 12.04.2024."

2. Today also none appears for the petitioner. The writ petitions are therefore dismissed for non-prosecution. There shall be no order as to costs. Consequently, MP Nos.1 of 2012 are closed.
