The learned counsel for the appellant submitted that R2 already died and steps are taken to implead his legal heirs as R3 to R9, in which the third respondent died, and the notice to R7 and R9 returned as unclaimed, and R4 was already abated.

Insofar as the other respondents, notice to the 8th respondent, cover returned as left.

Therefore, it is deemed that all the respondents are served with notice.

2.Accordingly, this civil miscellaneous petition is allowed and the Registry is directed to make necessary amendments in the cause title in the second appeal.
