O R D E R
(The case has been heard through video conference) Petitioner, who was arrested and remanded to judicial custody on 29.10.2020 for the offence punishable under Section 448, 342, 392, 397 and 506(ii) IPC in Crime No.334 of 2019, seeks bail.
2. Totally there are 14 accused and the petitioner is A5. The case of the prosecution is that all the accused trespassed into the de-facto complainant's company and attacked the defacto complainant and stolen a sum of Rs.20 lakhs from the company. Hence, a case has been registered against the petitioner.
3. The learned counsel for the petitioner would submit that the petitioner is no way connected with the offence and he has been falsely implicated in this case. Hence, he seeks bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having 17 previous https://hcservices.ecourts.gov.in/hcservices/
cases and a sum of Rs.17,50,000/- has been recovered from the all the accused and a sum of Rupees one lakh has been recovered from this petitioner. Hence, she vehemently opposed to grant bail to the petitioner.
5. Considering the said facts and circumstances of the case and also considering the gravity of the offence and also the fact that petitioner is having 17 previous cases and also recovery of the sum of Rupees one lakh from the petitioner, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed accordingly.
