Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned notification issued by the second respondent in Notification No.20/MRB/2025 dated 15.12.2025 in so far as it prescribes a common weightage marks based selection methodology for Diploma and Degree qualified candidate for the post of Radiographer and quash the same as arbitrary and consequently direct the second respondent to adopt a fair and equitable selection mechanism by providing separate consideration and to fix the reasonable ratio for diploma holders in the recruitment to the said post and to complete the selection process accordingly. The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the notification issued by the second respondent in Notification 2/6
No.20/MRB/2025 dated 15.12.2025 in so far as it prescribes a common weightage marks based selection methodology for Diploma and Degree qualified candidate for the post of Radiographer and quash the same as arbitrary and consequently direct the second respondent to adopt a fair and equitable selection mechanism by providing separate consideration and to fix the reasonable ratio for diploma holders in the recruitment to the said post and to complete the selection process accordingly.
2.The learned counsel appearing for the petitioners submitted that the petitioners after completing SSLC and Higher Secondary completed Diploma Course in Radio Diagnosis Technology. The second respondent issued the impugned Notification dated 15.12.2025 inviting application to the post of Radiographer, wherein both Diploma qualified and Degree qualified candidates are treated as eligible. Earlier recruitment to the post of Radiographer was made by treating only the Diploma holders as eligible candidates and Diploma qualified persons have been continuously appointed for the said post. Thereafter the respondents amended the educational qualification that the Degree holders are also eligible for the Radiographer post. The grievance of the petitioners is that though the respondents treat 3/6
Diploma and Degree qualifications as equal for eligibility, the adoption of a common merit list based solely on academic marks creates a structurally unequal and anti competitive playing field. The Degree candidates, by virtue of having a higher number of subjects and internal assessment components, enjoy an inherent advantage, resulting in Diploma candidates being unfairly eliminated from consideration.
3.The learned Government Advocate submitted that there is no discrimination or arbitrariness while awarding weightage marks. 50% is awarded for completion of Diploma or Degree Course, 30% is awarded for completion of Higher Secondary Course and 20% is awarded for completion of SSLC. Hence the grievance of the petitioners is not sustainable one. The last date for submission of application is 04.01.2026, however, the petitioners submitted the application only on 06.01.2026. Further other candidates cannot be deprived from granting opportunity of selection to the said post. 4.Perusal of impugned Notification reveal that there is no discrimination or arbitrariness while awarding weightage marks. 50% is awarded for completion of Diploma or Degree Course, 30% is 4/6
awarded for completion of Higher Secondary Course and 20% is awarded for completion of SSLC. Hence the grievance of the petitioners is not sustainable one.
