The applicant has filed a memo stating that as follows: "The applicant states that the objection of respondents with respect to the sole arbitrator and for extension of mandate is without any merit but however the applicant without prejudice to its right and without going into the said averments in the counter is agreeable for appointment of a sole arbitrator by the Hon'ble Court."

2. The said memo is taken on record.

3. Accordingly, it is ordered as follows:

(i) Ms. R. Meenal, Advocate, 11 Second Street, Jegadambal Colony, Royapettah, Chennai14, Email id1/3

meenalraghuvamsam@gmail.com, Mobile No.9840353442, is appointed as the Arbitrator to enter upon reference and adjudicate the disputes inter se the parties. The Arbitrator shall continue from the stage at which the earlier Arbitrator had concluded proceedings. ii) The learned Arbitrator may, after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of one year from the date of receipt of the order. It is open to the respondents to raise all legal objections as to the validity of contract.

iii) The learned Arbitrator is at liberty to fix her remuneration and other incidental expenses as per law.

iv) The proceedings may be conducted under the aegis of the Madras High Court Arbitration Centre and in accordance with the Madras High Court Arbitration Rules.

The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
