Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the first respondent to dispose the appeal No.16624/U3/2016 dated 26.4.2016 filed by the petitioner within the time prescribed by this Hon'ble Court.

ORDER

By consent, the writ petition is taken up for final disposal.

Mr.A.N.Thambidurai, learned Special Government Pleader accepts notice on behalf of the respondents.

It is the claim of the petitioner that the property admeasuring to an extent of 0.73.00 Hectare (1.80 cents) comprised in S.No.29/1B situated at Chennappanaikanoor village, Uthangarai Taluk, Krishnagiri District belong to his father and his brother S.Varadarajan and both had enjoyed the same and UDR Patta No.349 was also issued jointly in the name of the father of the petitioner and in the name of S.Varadharajan in the year

1987 itself. The petitioner would state that suppressing the above said facts, the said Varadarajan and his son and daughter had created a family partition deed by way of document No.3106/2007, dated 03.09.2007 on the file of the office of the Sub Registrar Office, Uthangarai and in this regard, the petitioner has given a complaint to the office of the first respondent alleging fraud and also drawn the attention in that regard and the office of the first respondent in its communication dated 19.05.2016 in Reference No.20007/C1/2016, informed the petitioner that further action is being taken in File No.166424/U3/16 and since no further progress has been made, the petitioner came forward to file this writ petition.

3. The Court heard the submissions of Mr.A.N.Thambidurai, learned Special Government Pleader appearing for the respondents.

4. This Court, taking into consideration of the above said facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the Public Information Officer/Superintendent "C" Section of the office of the first respondent to act on the communication dated 19.5.2016 in Reference No.20007/C1/2016 and after putting the concerned person/s on notice, shall pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as the person/s concerned.

5. The writ petition, accordingly, stands disposed of. No costs.
