O R D E R
By consent, the writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to pay the pending amount of difference of Service Gratuity of Rs.1,03,950/- and difference of Leave Salary of Rs.56,287/- to the petitioner as communicated as reply under Right to Information Act, 2005 along with interest at the rate of 6% per annum payable from the date of retirement in the light of judgment passed by this High Court on 18.10.2024 in W.P.No.30627 of 2024 within the time that may be stipulated by this Court.
3.The learned counsel appearing for the petitioner submitted that the petitioner entered the services of the respondent Corporation as Junior Tradesman on 16.07.1992 and retired from service as Senior 2/5
Tradesman on 30.04.2020. Thereafter, the petitioner sought for information under the Right to Information Act, 2005 about the pending quantum of the difference of service gratuity and the difference of leave salary and the respondents vide letter dated 08.10.2025 communicated the petitioner that a sum of Rs.1,03,950/- as difference of gratuity amount and a sum of Rs.56,287/- as difference of leave salary and hence, the petitioner made representation dated 19.12.2025 to the respondents to make the above payments, however, there is no response. Hence, this Court may issue direction to the respondents to pay the pending amount of difference of service gratuity of Rs.1,03,950/- and difference of leave salary of Rs.56,287/- to the petitioner as communicated as reply under Right to Information Act, 2005 along with interest at the rate of 6% per annum payable from the date of retirement, by considering the petitioner's representation dated 19.12.2025, within a reasonable time frame.
4.Since the respondents vide letter dated 08.10.2025 have communicated the petitioner that a sum of Rs.1,03,950/- as difference of gratuity amount and a sum of Rs.56,287/- as difference of leave Salary, this Court, directs the respondents to disburse the said 3/5
amounts to the petitioner, along with interest at the rate of 6% per annum payable from the date of petitioner's retirement to till the date of payment the said amount, within a period of four weeks from the date of receipt of a copy of this order.
