Subsequently, at the request of the learned counsel for the appellant, the matter was posted on 12.06.2023 & 13.06.2023. On 20.06.2023, when the matter was called, there was no Page 1/3

representation for the appellant. Hence, the Registry was again directed to post the matter under the caption 'for dismissal' on 21.06.2023. Even today, when the matter is called, there is no representation for the appellant. Therefore, we have no other option except to dismiss the appeal for non-prosecution. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.
