ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 25.10.2021 for the offence under Section 120-B, 109, 143, 147, 148, 341, 302 IPC and Section 3, 4 of Explosive Substances Act, 1908 read with Section 149 IPC, in Crime No.185 of 2021, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 24.10.2021, the petitioner and other accused persons, due to previous enmity, waylaid the defacto complainant's son and his friend and hurled country made bomb and also assaulted them with deadly weapons like veech aruval and committed murder. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he is no way connected with the alleged offence. He would further submit that based on alleged confession statement from one of the arrested accused, he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for more than 85 days and hence, he would pray for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. Mr.Balamurugane, Additional Public Prosecutor (Puducherry) would raise strong objection stating that there are totally 22 accused in this case and nine accused are yet to be arrested and one of the accused has been arrested today. He would further submit that the investigation is still pending.
5. On seeing the above facts and circumstances of the case and the conduct of the petitioner, this Court is of the opinion that if the petitioner is released on bail, there is every possibility of the petitioner getting abscond and tampering the evidence. Hence, this Court is not inclined to grant bail to the petitioner.
