Writ Petition (Criminal) filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1, 2 and 5 to give necessary force of Police protection to survey the petitioner property comprised in S.No.232/2A1B, Old S.No.339/2 to an extent of 0-12.14 Ares (Acres 0.30 Cents) situated at Silambinathanpettai Revenue Village, Panruti (Taluk), Cuddalore District, and to fix the boundaries so as to fence the 1/6

This writ petition (criminal) has been filed seeking to direct the respondents 1, 2 and 5 to give necessary police protection on any of the date to be fixed by the 3rd and 4th respondents, in order to survey the petitioner's property and to fix boundaries, so as to enable the petitioner to fence the property, by considering the petitioner's representation dated 17.12.2025.
2. Mr.K.M.D.Muhilan, learned Additional Public Prosecutor, takes notice on behalf of the respondents 1, 2 and 5. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal) is taken up for final disposal at the admission stage itself.
3. Since no order adverse to the interest of the respondents 3, 4 and 6 is passed, notice to the said respondents is dispensed with. 2/6

Learned counsel for the petitioner submitted that the petitioner is the absolute owner of the property comprised in S.No.232/2A1B, Old S.No.339/2, measuring an extent of 0-12.14 Ares (Acres 0.30 Cents), situated at Silambinathanpettai Revenue Village, Panruti (Taluk), Cuddalore District and the same has been purchased by the petitioner, vide registered sale deed dated 17.03.2025 bearing Doc.No.532 of 2025. In order to fence his property, the petitioner approached the 3rd respondent and also paid the necessary charges for surveying and fixing boundaries, pursuant to which, though the 3rd respondent sent summons to the 6th respondent on various dates, as the 6th respondent, who is the adjacent land owner opposed for surveying the land, the surveyors could not survey the petitioner's land.
Therefore, the petitioner approached the 5th respondent seeking necessary police protection and he also made a representation dated 17.12.2025 before the 1st and 2nd respondents in this regard. In the mean time, on 15.12.2025, the petitioner had once again paid necessary charges for surveying his land. However, the 5th respondent had failed to provide necessary police protection for measuring/surveying and fixing boundaries in the petitioner's property. Hence, the petitioner has come up with this writ petition (criminal).

Per contra, the learned Additional Public Prosecutor appearing for the respondents 1, 2 and 5, submitted that till date, the 5th respondent has not received any communication from the 3rd respondent, seeking police protection for surveying the petitioner's property and if any such communication is received from the 3rd respondent seeking police protection for surveying and fixing boundaries in the petitioner's property, necessary police protection will be provided by the 5th respondent.

In view of the above submission made by the learned Additional Public Prosecutor, this Court, without going into the merits of the case, directs the 5th respondent to accord necessary police protection for surveying and fixing boundaries in the petitioner's property, upon receipt of communication from the revenue officials, after a specific date is fixed by the revenue authorities.
7. This writ petition (criminal) stands disposed of accordingly. No costs.
