This petition has been filed to challenge the proceedings in S.C.No.100 of 2022 on the file of the Mahila Court, Chengalpet. 2.The petitioner is the complainant. On the complaint, the 3rd respondent registered FIR in Crime No.95 of 2021 under Section 174(3) of the Cr.PC and was thereafter altered the same into Section 306 of IPC. After completion of the investigation, final report was filed. According to the petitioner, there was dowry demand and is the cause of murder of her daughter. Even there are materials to show that there was dowry demand and torture, the 3rd respondent did not file a final report invoking Section 418 and other offences. Further, it is a case of murder and there are materials to attract the offences under Section 302 of IPC. Even the 3rd respondent did not file a final report under Section 302 of IPC. Now the 2/4
summons issued before the witnesses and posted for examination of prosecution witnesses. If at all any offences left out as against the accused person and if at all any accused persons are left out while taking the final report, the 3rd respondent can very well invoke Sections 216 and 319 of Cr.PC before the Trial Court during the trial. If any materials available to attract the other offences, the Trial Court is directed to entertain the petition under Sections 216 and 319 of Cr.PC and deal with the same in accordance with law.
3.With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed.
