Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the second and third respondents to grant family pension and for payment of arrears of family pension to the petitioner from 26.12.2017, the day following the date of the death of the petitioner's husband by following (i) 2008 (5) CTC 294,

(ii) 2014 (4) L.W. 297, (iii) order dated 23.01.2020 passed in W.P.No.34952 of 2019, (iv) order dated 20.11.2013 passed in W.A.No.2167 of 2010.

ORDER

This Writ Petition has been filed for a direction directing the second and third respondents to grant family pension and for payment of arrears of family pension to the petitioner from 26.12.2017, the day following the date of the death of the petitioner's husband.

2. Heard Mr.V.S.Jagadeesan, learned counsel appearing for the petitioner and Mr.A.M.Ayyadurai, learned Government Advocate appearing for the first respondent and Mr.C.S.K.Sathish, learned counsel appearing for the third respondent and perused the materials available on record.

3. Without expressing any opinion on the merits of the writ petition, the second respondent is directed to consider the case of the petitioner and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition stands disposed of. No costs.
