ORDER
The petitioner, who was arrested and remanded to judicial custody on 28.12.2025 for the alleged offence under Section 303(2), 62, 126(2), 132, 351(3) of BNS r/w. Section 21(1)(4) of Mines and Mineral Act, in Crime No.385 of 2025 on the file of the respondent police, seeks bail.
2.The allegation against the petitioner is that he was involved in the illegal quarrying of sand from the Anandur lake using a tipper lorry and earthmover. Based on information, officials went there, stopped the illegal quarrying, and arrested the petitioner. Hence, the case has been registered.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. The petitioner has been in judicial custody since 28.12.2025 and is ready to abide by any stringent conditions imposed by this Court. Hence, he prays for the grant of bail to the petitioner.
4. The learned Government Advocate (Criminal Side) for the respondent police reiterated the prosecution case and submitted that the petitioner has a bad antecedent, the property has been recovered, and the petitioner has two previous cases. Hence, he opposed the grant of bail to the petitioner.
5. Considering the fact that the petitioner joined hands with other accused by using earthmovers and a tipper lorry and took sand from the lake, and taking note of the fact that the petitioner is not only damaging the riverbed but also causing damage to the ecology, this Court is not inclined to grant bail to the
