ORDER

This Criminal original petition is filed seeking a direction to the respondent to register the complaint dated 01.04.2014 and consequently to file a final report thereon.

2. This petition has come up today for admission. I have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and I have also perused the records carefully.

3. The learned Additional Public Prosecutor submits that the opposite party has filed O.S.No.63 of 2015 before the District Munsif Court, Gudiyatham against this petitioner and the suit is pending.

4. The learned counsel for the petitioner submits that no interim order has been given in the said suit.

5. Under such circumstances, no positive direction can be issued to the police to register a case. The respondent police is directed to enquire into CSR.No.119 of 2015 and take action in accordance with law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)].

5.This Criminal Original Petition is closed with the above direction.
