ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody through P.T on 23.11.2020 for the alleged offences punishable under Sections 341, 294(b), 342, 327, 307, 336, 427 and 506(ii) of IPC, in Crime No.133 of 2018, seeks bail.
2. There are totally two accused in this case and the petitioner is A2. The case of the prosecution is that the petitioner and other accused wrongfully restrained the de-facto complainant, attacked him with deadly weapons and also robbed cash of Rs.2,000/-. Hence, crime has been registered and the petitioner was arrested and remanded to judicial custody on 23.11.2020.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody since 23.11.2020. Hence, he prays for grant of bail.
4. The learned Additional Public Prosecutor would submit that the petitioner is an habitual offender and he is having twelve previous cases against him which are all similar in nature. Hence, she vehemently opposed for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the facts and circumstances of the case and also of the fact that the petitioner is an habitual offender and he is having twelve previous cases, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition stands dismissed.
