This Writ Petition has been filed seeking a Certioraried Mandamus, calling for the records of the first respondent relating to the award in I.D.No.706 of 2002 dated 09.02.2011 and quash the same and consequently direct the second respondent to pay backwages to the petitioner.
2. On 13.11.2021, it was brought to the notice of this Court that the petitioner is no more and the learned counsel for the petitioner had sought time for taking appropriate steps. Again, when the matter was listed on 23.06.2023, time was sought by the learned counsel for the petitioner to bring legal heirs of the deceased petitioner on record.
3. Today, when this matter is taken up for consideration, it is reported by learned counsel for the petitioner that despite of making his best efforts, he is unable to reach the legal heirs of the deceased petitioner and hence, the learned counsel for the petitioner could not take appropriate steps for bringing legal heirs of the deceased petitioner on record. Thus, it is evident that the petitioner has died as early as in the year 2021, but no application is filed to
bring legal heirs on record and proceedings have abated.
4. Accordingly, the Writ Petition stands closed, leaving it open to the legal heirs of the deceased petitioner to take steps in the event, if they so decide to do so. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed. 28.11.2023 skr Index : Yes / No Speaking order / Non-speaking order To
