PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the second respondent to accept the Settlement Deed dated 09.12.2022 for registration thereby considering the petitioner's Application for Pre-Registration Token Receipt No.TP/139046442/2022 dated 09.12.2022 on the file of S.R.O., Magudanchavadi, Salem District within a stipulated time fixed by this Court.

ORDER

Heard Mr.N.Vijaya Basker, learned counsel for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader for the respondents.

2.The limited prayer sought for by the petitioner is for a direction to the second respondent to accept the Settlement Deed dated 09.12.2022 as per the Pre-Registration Token Receipt No.TP/139046442/2022 dated 09.12.2022.

3.Today, when the matter is called, the learned Special Government Pleader for the respondents, on written instructions from the Sub Registrar, Sub-Registrar Office, Magudanchavadi, the second respondent herein submitted that if such a document is produced before the second respondent, the same would be considered in accordance with the procedure contemplated under the Registration Act and the Rules. 2/4

4.In view of the submission made by the learned Special Government Pleader for the respondents, the petitioner is granted liberty to produce relevant Settlement Deed dated 09.12.2022 before the second respondent herein, who on receipt of the same, shall register the same, if it is otherwise in order, within a period of two weeks from the date of such presentation. Accordingly, the writ petition stands allowed. No costs.
