.. Defendant This Civil Suit is filed under Order IV Rule 1 of the Original Side Rules read with Order VII Rule 1 of C.P.C, 1908, prayed for a judgment and decree against the Defendant:- 1/4

i).For permanent injunction restraining the defendant or its officers or men or agents from in any manner taking unilateral decisions with respect to the leasehold lands or proceeding with the construction of the club house or any other development on the Cosmo-TNGF Golf Course established on the Joint Lease hold land of the plaintiff and the defendant measuring an extent of 80.40 acres comprised in T.S.No.2, Block No.8, Government Farm Village, Guindy Taluk, Chennai District. ii).To pay the cost of the suit.

JUDGMENT

A memo has been filed by the plaintiff indicating that the issues between the plaintiff and the defendant have been settled through mediation. A mediator had been appointed by the Hon'ble Supreme Court of India in S.L.P (C) No.16078 of 2022 by order dated 23.09.2022. The Settlement Agreement has also been enclosed along with the memo. 2/4

2.In view of those circumstances, the Suit is dismissed as settled through mediation. No order as to costs. The plaintiff is entitled for refund of Court fee in accordance with the rules.
