PRAYER: Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of Writ of Certiorarified Mandamus, to call for the records from the 2nd respondent herein pertaining to the impugned rejection of renewal order passed by the 2nd respondent in No.008/SDC/Part-B/2022-2023/27 dated 23.03.2023 and quash the same and consequently, direct the 2nd respondent herein to renew the certificate within a time frame. ORDER

This Writ Petition has been filed challenging the impugned order dated 23.03.2023 passed by the 2nd respondent, rejecting the petitioner's renewal application and for a direction to the 2nd respondent to renew the certificates of the petitioner.

2. The learned counsel appearing for the petitioner would submit that the petitioner made a renewal application dated 24.03.2022 before the 2nd respondent for renewal of his certificates however, the 2nd respondent rejected the same on the ground that the date of birth in Aadhaar card differs from the Gazette Notification. Challenging the same, the present writ petition is filed.

3. The learned counsel for the petitioner would submit that this Court may grant liberty to make a fresh application with correct particulars and direct the respondents to consider the same within a specified time.

4. The learned Additional Government Pleader (Puducherry) appearing for the respondents would submit that if the petitioner made any fresh application, the 2/5

respondents will consider the same and pass appropriate orders within a specified time.

5. In view of the same, there will be a direction to the petitioner to make a fresh application with correct particulars within a period of two weeks from the date of receipt of a copy of this order and, if any such application is made, the 2nd respondent is directed to consider the same and pass appropriate orders in accordance with law within a period of three weeks from the date of such application.
