Respondent Contempt Petition filed under Section 11 of the Contempt of Courts Act to punish the respondent for their wilful disobedience of the order of this Court dated 23.11.2016 in W.P.No.41122 of 2016.

ORDER

This Court, by order dated 23.11.2016, disposed of the writ petition in WP.No.41122 of 2016, on the following terms:

"The respondent/Revenue Divisional Officer, Dharmapuri District is directed to investigate the application in an open and transparent

fashion, affording opportunity of hearing to the petitioner. In which process, as repeatedly held by this Curt, the candidate shall have full liberty to explain the documents placed by him or collected by the investigating agency and he shall have opportunity to cross examine the witnesses, if required. The entire exercise shall be completed by the respondent, as stipulated by the Supreme Court, in the case of Kumari Madhuri Patil and another v. Addl. Commissioner, Tribal Development and others (1994) 6 SCC 1 and pass necessary order, within 3 months from the date of receipt of a copy of this order."

Since the said order has not been complied with within the stipulated time, the petitioner has come up with the present Contempt Petition.

2.When the matter was taken up for consideration, the learned Special Government Pleader appearing for the respondent submitted that as directed by this Court, the respondent has conducted investigation and passed an order, rejecting the request of the petitioner. The learned Special Government Pleader also produced a copy of the proceedings bearing No.Pa.Mu.935/2017/A4 dated 15.02.2018 issued by the respondent, to that effect.

3.In the light of the aforesaid submission and the communication so produced by the learned Special Government Pleader for the respondent, this Court is of the opinion

that it is unnecessary to pursue this Contempt Petition. Hence, recording the same, the Contempt Petition stands closed.
