Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S P.SATHIYA, Advocate for the petitioner and of MR. S.BALAJI, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- The petitioner has filed this Miscellaneous petition seeking cancellation of Anticipatory Bail granted by this Court vide order dated 26.10.2021 to the private respondents/ 1st and 2nd respondents.
2. When the matter is taken up for hearing, the learned counsel for the petitioner submitted that, this Court vide its order dated 26.10.2021 granted Anticipatory bail to the 1st and 2nd respondents / private respondents on condition that they have to deposit a sum of Rs.2,13,000/-(Rupees Tow Lakhs Thirteen Thousand only) to the credit of Cr.No.208 of 2021. However, the same was not complied with by the 1st and 2nd respondents / private respondents. He further submitted that, the notice to the private respondents has been returned with an endorsement "unclaimed". Hence, the present Miscellaneous petition is filed seeking cancellation of bail granted to the private respondents.
3. The learned Government Advocate (Crl.Side) on instructions submitted that the 1st and 2nd respondents have not complied with the orders of this Court dated 26.10.2021.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side).
5. In view of the above submissions made by the learned counsel, since the 1st and 2nd respondents / private respondents have not complied with the order of this Court, the anticipatory bail granted by this Court vide order dated 26.10.2021 stands vacated.
