Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the respondent to forthwith consider and pass orders on the representation of the petitioners dated 23.06.2015 for assignment of 6 cents of land in S.No. 58/3 at Kilumathur Village, Kunnam Taluk, Perambalur District.

The petitioners made a representation on 23.06.2015 to the Sub Collector, Perambalur District, seeking assignment of 6 cents of Government land in Survey No. 58/3 or to give a permanent solution to the petitioners so as to enable them to use the said land as a pathway to reach their property from the main road. On receipt of the representation, the Sub Collector directed the respondent herein to conduct necessary field inspection and to submit his report for further action. Though the respondent conducted field inspection and also obtained statements from the petitioners and others. Thereafter, the petitioners have also submitted another representation dated 18.12.2015 to the District Collector requesting to assign and to give patta to the petitioners for 6 cents of land in the aforesaid survey number or to give a permanent solution by classifying the said extent of land as pathway so as to enable the petitioners to reach the main road from their property. https://hcservices.ecourts.gov.in/hcservices/

Though, according to the petitioners, the respondent has acknowledged the receipt of both the representations, no orders have been passed on either of the said representations. Hence, the petitioners have come forward with the present writ petition. 2.

Considering the limited scope of the relief sought, the respondent is directed to consider the earlier representation of the petitioners dated 23.06.2015, pursuant to which field inspection was conducted, statements were obtained and a sketch was also prepared and pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
