CMP.Nos.16023, 16024, 16025, 16026, 16027 & 16028 of 2005 in S.A.Nos.1166 & 1167 of 1994 CMP.Nos.16023, 16024, 16025, 16026, 16027 & 16028 of 2005 in S.A.Nos.1166 & 1167 of 1994 RMT.TEEKAA RAMAN,J., CMP.Nos.16023 & 16026 of 2005 have been filed to condone the delay of 3232 days in seeking to set aside the abatement caused due to the death of the deceased sole appellant viz., C.B.Panchatchara Mudaliar, in the above second appeals. CMP.Nos.16024 & 16027 of 2005 have been filed to set aside the abatement caused due to the death of deceased/sole appellant in the above second appeals. CMP.Nos.16025 & 16028 of 2005 have been filed to bring on record the proposed parte/petitioner in these CMPs as the legal representative of the deceased and rank her as the second appellant in the above second appeals. 2.The factum of the death and the petitioner/proposed parte as his legal representative, are not in dispute.
3.Considering the submissions made by the learned counsel for the appellants and being satisfied with the reasons stated in the affidavit filed in support of these applications, in the interest of justice, all these petitions are allowed.
