ORDER
This Criminal Original Petition has been filed by the defacto complainant to direct the learned Judicial Magistrate No.I, Udumalpet, Tiruppur District to dispose of the case in C.C.No.423 of 2013 at early.
2. The learned counsel for the petitioner has submitted that based on the complaint lodged by the petitioner, a case was registered in Crime No.4 of 2012 on the file of the respondent against the petitioner's husband GopalaKrishnan for the offences u/s.494, 506(ii) IPC. He further submitted that the respondent after investigation, filed a charge sheet and based on the same, the learned Judicial Magistrate No.I, Udumalpet, Tiruppur District has taken the cae on file in C.C.No.423 of 2013. He further submitted that so far, eight witnesses were examined on the side of the prosecution. But https://hcservices.ecourts.gov.in/hcservices/
the remaining witnesses not produced by the respondent and hence the case is pending from the year 2013. Therefore, he prayed to direct the trial court to dispose of the aforesaid case at early.
3. The learned Additional Public Prosecutor has submitted that P.Ws.3,4,5 and 8 were examined in chief. But they were not cross examined by the accused. He further submitted that out of 17 witnesses, already 8 witnesses were examined, only 9 more witnesses yet to be examined and therefore he prayed to fix a reasonable time to dispose of the aforesaid case.
4. Considering the aforesaid facts, the respondent is directed to produce the remaining witnesses without seeking unnecessary adjournments. The learned trial judge is directed to dispose of the aforesaid case within four months from the date receipt of copy of this order.
5. With the aforesaid directions, this Criminal Original Petition is disposed of.
