The petitioner who was arrested and remanded to judicial custody on 29.08.2022 for the offence punishable under Sections 8(c) r/w 20(b)(ii)(C),29(1) and 25 of NDPS Act in C.R..No.178 of 2022 seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 21.300 kgs of ganja. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner has no previous antecedents and he is the sole bread winner of his family. He submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence prays for grant of bail.

smn 4.The learned Government Advocate (Crl.Side) would submit that the quantity involved in this case is more than commercial quantity. He further submits that there are 13 previous cases pending against the petitioner and he has also filed a counter to that effect. Hence he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and the quantity of contraband involved in this case and there are 13 previous cases pending against the petitioner, this court is not inclined to grant bail to the petitioner.
