ORDER

The petitioner, who was arrested and remanded to judicial custody on 28.10.2024 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, in Crime No.46 of 2024 on the file of the respondent police, seek bail.

2. The case of the prosecution is that there are totally six accused and the petitioner is arrayed as A5, and the total contraband involved in the case is 303 kgs of ganja. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been in custody since 28.10.2024 and is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) for the respondent police reiterated the prosecution case and submitted that the total contraband involved in the case is 303 kgs of ganja, which falls within the commercial quantity, and that there are 14 previous cases against the petitioner. Hence, he opposed the grant of bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. Considering the nature of the allegations and the fact that the contraband involved in the case is 303 kgs of ganja, which falls within the commercial quantity, the rigour of Section 37(1)(b)(ii) of the NDPS Act operates against the petitioner. In such view of the matter, this Court is of the view that there are no extenuating circumstances in favour of the petitioner to grant bail.
