The defendant, viz., T.Kondiah before the Trial Court, passed away after the impugned order came to be passed, thereby necessitating the filing of an application to accept the cause title.

2. Heard the learned counsel for the petitioner.

3. Considering the reasons stated in the affidavit filed in support of the petition to accept the cause title and being satisfied with the reasons stated, this petition is ordered as prayed for.
