ORDER

The petitioners were arrested and remanded to judicial custody on 10.12.2025 for the offences punishable under Sections 296(b) and 109(1) of BNS Act, 2023 in Crime No.523 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioners is that, due to previous enmity they poured the hot oil on the victim and attempted to commit murder. Hence, a complaint was lodged and the petitioner was arrested.

3. Learned counsel appearing for the petitioners submitted that the petitioners are in judicial custody since 10.12.2025 and that the petitioners are not having any previous cases pending against them. Hence, he prayed to grant bail to the petitioners.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally three accused in this case and the petitioners are ranked as A1 and A2. He further submitted that the injured was discharged from the hospital and that the petitioners are not having any previous cases against them. Hence, he opposed to grant bail to the petitioners.

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the submissions made by the learned counsel on both sides, the nature of the allegations, the fact that the injured was discharged from the hospital, and that the petitioners have no previous cases against them and also considering the period of their incarceration, this Court is inclined to grant bail to the petitioners with certain conditions.

7. Accordingly, the petitioners are ordered to be released on bail on their 2/5

executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Hosur and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation. [c] the petitioners shall not abscond either during investigation or trial;

[d] the petitioners shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
