ORDER

This writ petition has been filed for a Mandamus to direct the respondent to conclude the enquiry pursuant to the petitioner's complaint dated 02.08.2019.

2. Mr.K.R.Tamizhmani, learned counsel for the respondent would submit that based on the complaint, the respondent has initiated action on 04.02.2021 and also communicated the same to the petitioner and also filed a counter affidavit stating the said fact.

3. Learned counsel for the petitioner raised serious objections with regard to the statement made in paragraph No.3 of the counter that the complaint was made since the petitioner is said to have been removed from service of Tolani Maritime Institute on 03.08.2019.

4. In reply, Mr.K.R.Tamizhmani, learned counsel appearing for the respondent would submit that they have referred to the factual aspects and the investigation will be proceeded only on the merits of the complaint and not based on the averment made in paragraph No.3 of the counter. He would further submit that the writ petition may be closed as the prayer sought for by the petitioner has become infructuous.

5. Recording the statement made by the learned counsel for the respondent, this Writ Petition is closed. No costs.
