ORDER
This Criminal Original Petition has been filed seeking for transfer of investigation in Crime No.1121 of 2015 from the file of the 1st respondent to the file of the 2nd respondent. 2.The learned counsel for the petitioner submitted that the petitioner passed away in the year 2017 and he has got no further instruction with regard to the case.
3.The learned Additional Public Prosecutor appearing for the respondents submitted that despite several notice to the petitioner, he had not responded and failed to appear for investigation and hence, the FIR is still kept pending. 4.On the submission of the learned Additional Public Prosecutor and in view of the death of the petitioner, nothing survives for further adjudication. Hence, the petition is dismissed. Consequently, the connected miscellaneous petition is closed.
