Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to Writ of Mandamus to direct the respondents herein to stop all the illegal activities of the 4th respondent herein with regard to the petitioner property situated at Pichagundapalli Village, Hosur Taluk, Krishnagiri, comprised in S.No.19, 20/1, 20/2, 22/1, 22/2 and 23 having a total extent of 23.68 acres in favour of the petitioner herein. This writ petition seeks a mandamus directing the respondents to stop all the illegal activities of the 4th respondent herein with regard to the petitioner's property situated at Pichagundapalli Village, Hosur Taluk, Krishnagiri, comprised in S.No.19, 20/1, 20/2, 22/1, 22/2 and 23 having a total extent of 23.68 acres in regard to which a representation dated 02.01.2021 has been filed by the petitioner. dispatch or acknowledgement has been placed on file in regard to the aforesaid representation.
2. This matter had come up for hearing on 04.02.2021 when I expressed a view that the Writ Petition was pre-mature and that the petitioner, if at all such representation had been filed, could well pursue the same before the authorities.
3. Learned counsel for the petitioner sought a days' time to withdraw the writ petition and requested that the matter be listed today under the caption 'for withdrawal'.
4. However, today he submits that he has no instructions to withdraw the Writ Petition. I thus reiterate the view expressed on 04.01.2021 to the effect that the Writ Petition is pre-mature seeing as the representation is itself very recent dated 02.01.2021 and there is not even an acknowledgement for having sent the same.
5. This Writ Petition is dismissed. No costs. Connected Miscellaneous Petition is also dismissed.
